countywide voting violates voter privacy & ballot secrecy

Did you know?

As a result of our recount of the March 5, 2024 Republican Primary, we uncovered evidence of broken chain of custody, fraud, unsigned ballots, missing ballots, and much more. It didn't take long to realize that countywide voting was a source of a lot of these issues and lack of true auditability.

 

As we looked deeper into the countywide voting issues, we uncovered evidence confirming that just under 20,000 Dallas County and well over 100,000 Texas voters' constitutional rights of voter privacy and ballot secrecy were violated.


On May 17,2024 Barry Wernick sent a declaration of truth and a petition for a redress of grievances concerning the findings of unconstitutionality of countywide voting relating to the blatant violations of voter privacy and ballot secrecy to the Secretary of State, and the county judges and election administrators of the 96 Texas counties that have opted in to the Countywide Polling Place Program (CWPPP) provided for by the Texas Election Code Section 43.0007. 



Applicable Federal & State Laws Related to Balancing Ballot Secrecy & Transparency

A thorough review of the following laws and statutes reveals the flaw with countywide voting is that there is no legal way to strike a balance. 

Thus it is, in and of itself, illegal. 

Texas Election Code § 122.001(a)(1): A voting system may not be used in an election unless the system preserves the secrecy of the ballot. 

Texas Constitution Article 6, Section 4: In all elections by the people, the vote shall be by ballot, and the Legislature shall provide for the numbering of tickets and make such other regulations as may be necessary to detect and punish fraud and preserve the purity of the ballot box; and the Legislature shall provide by law for the registration of all voters.

52 U.S.C. § 21081(a)(2)(A): The voting system shall produce a record with an audit capacity for such system.

Texas Election Code § 122.001(a)(10): A voting system may not be used in an election unless the system is capable of providing records from which the operation of the voting system may be audited.

Civil Rights Act of 1960 § 301: requiring the preservation of all records relating to any “act requisite to voting” codified in 52 U.S.C. §§ 20701-20706

52 U.S.C. § 21081(a)(2)(B)(i): The voting system shall produce a permanent paper record with a manual audit capacity for such system.
